Terms of Use
Effective Date: April 25, 2025
1. Acceptance
By downloading or using SPED Goals (“the App”), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.
2. Eligibility
The App is intended for educators and school professionals aged 18 or older. You represent that you are an authorized educator and that your use complies with all applicable laws, including FERPA and IDEA.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal professional use. You may not: copy, modify, distribute, sell, or reverse-engineer the App; use the App to build a competing product; or scrape data from the App.
4. User Accounts
You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access to your account.
5. Student Data Responsibility
You are solely responsible for the accuracy and appropriateness of any student data you enter into the App. Do not enter more student personally identifiable information than is necessary. You agree to comply with FERPA and any applicable district data governance policies.
6. Subscriptions and Payments
Premium features require an active subscription purchased through Apple In-App Purchases. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Manage or cancel subscriptions in your Apple ID settings. We do not offer refunds outside Apple's refund policies.
7. Intellectual Property
All content, trademarks, and code in the App are owned by SPED Goals or its licensors. Nothing in these Terms grants you ownership of any App content.
8. Disclaimer of Warranties
The App is provided “as is” without warranty of any kind. We do not warrant that the App will be uninterrupted, error-free, or suitable for any particular purpose.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including loss of student data.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. The App is operated by Upquarks Inc., Bay Harbor Islands, FL.
11. Changes
We may update these Terms at any time. Continued use after a change constitutes acceptance of the new Terms.
